Every employment, licensure, earnings, tuition and financial-aid statement is the school's to approve first. Under the Department of Education's program participation agreement, an institution that advertises job placement rates agrees to make the substantiating employment and graduation data, and the relevant state licensing requirements, available to prospective students at or before the time they apply for enrollment.

Institutional approval. Institutional approval is required for every employment, licensure, earnings, tuition and financial-aid statement; documented lead consent is used, and compensation structures or messaging that conflict with recruitment regulations are avoided.

34 CFR 668.14(b) provides that by entering into a program participation agreement, an institution agrees that, in the case of an institution that advertises job placement rates as a means of attracting students to enroll in the institution, the institution will make available to prospective students, at or before the time that those students apply for enrollment, (i) the most recent available data concerning employment statistics, graduation statistics, and any other information necessary to substantiate the truthfulness of the advertisements; and (ii) relevant State licensing requirements of the State in which the institution is located for any job for which the course of instruction is designed to prepare such prospective students.
