About these terms
This website is operated by MBI Direct Mail + Digital, Inc. (“MBI”), 710 W New Hampshire Ave, DeLand, FL 32720. By using it you agree to these Terms of Service (the “Terms”). Nothing on the site is an offer or a quote: printing, mailing, data and digital work is priced and governed by the written quote or agreement for that work. The site is run from Florida for visitors in the United States.
Information, not advice
Information on this website, including its guides, FAQs and industry pages, is provided for general informational purposes only and may not reflect the most current legal, regulatory, postal, platform or industry requirements. It is not legal, tax, financial, compliance or other professional advice and should not be relied upon as such. Customers are responsible for determining whether their campaigns, content, mailing lists, offers and advertising comply with applicable laws, regulations, postal requirements and platform policies. Where MBI supplies a mailing list or any other part of a campaign, the written agreement for that work sets out who is responsible for what.
No guaranteed results
MBI does not guarantee response rates, leads, registrations, attendance, sales, revenue, deliverability, placement, conversion rates, return on investment or any other campaign result. Past performance, examples, case studies and sample results do not guarantee future performance. Sample pieces, screens and figures shown on the site are illustrations.
Who owns what
The site’s text, design, images and code belong to MBI or are used with permission. Except as permitted by applicable law, you may not copy, reproduce, modify, distribute, publish, display, transmit, create derivative works from, commercially exploit or otherwise use material from this site without MBI’s prior written permission. MBI’s name and logo are our marks. USPS®, United States Postal Service®, Every Door Direct Mail® and EDDM® are trademarks of the United States Postal Service. Facebook, Instagram and Meta are trademarks of Meta Platforms, Inc., and Google is a trademark of Google LLC. All other names and logos belong to their owners. Open-source software and fonts used here are listed, with their licences, in our third-party notices.
Using the site
Use the site lawfully. Do not try to break, overload, probe or scrape it, submit false information through its forms, or use it to send anything harmful. What you send us is handled under our Privacy Policy. Links to other websites are provided for convenience; we are not responsible for them. We may block anyone who breaks these Terms, and we may share information with law enforcement where the law allows or requires it.
Accessibility
We want everyone to be able to use this site. We build and test it against the Web Content Accessibility Guidelines (WCAG) 2.2, level AA, with a keyboard and a screen reader as well as automated checks, and we keep working on it. If something does not work for you, call 800-359-4780 or use our contact page: we will help you get what you came for and fix the problem.
No warranty, limited liability
The site is provided as it is, without warranties of any kind, to the fullest extent the law allows. MBI is not liable for indirect, incidental or consequential losses arising from use of the site or reliance on its content, and its total liability for any claim arising from use of the site is limited to US$100. Nothing here limits liability that cannot be limited by law, or changes what a signed agreement with MBI provides.
General
You agree to indemnify, defend and hold harmless MBI and its officers, directors, employees and agents from claims, damages, losses, liabilities, costs and reasonable attorneys’ fees arising from your misuse of the website, violation of these Terms, violation of applicable law, or infringement of another person’s rights.
Nothing in these Terms or your use of the website creates a partnership, joint venture, employment, agency, fiduciary or other special relationship between you and MBI.
If a court finds any part of these Terms unenforceable, the rest still applies. These Terms are the whole agreement about using the site; a signed agreement with MBI governs the work it covers. If we do not enforce a term at one time, we have not given it up.
Governing law and changes
These Terms are governed by the laws of the State of Florida, and any dispute about the site belongs in the state or federal courts serving Volusia County, Florida. If the Terms change we will post the new version here with a new effective date.
